The Tenth Circuit Grants A Stay in Wisne v. NCAA: What It Means:

This morning, the US Court of Appeals in the Tenth Circuit granted a Stay for the Wisne v. NCAA case. This means that the umbrella federally protecting all players is now gone, and the State Lawsuits will kick in.

What is a Stay?

Per the Legal Information Institute (Cornell) – ” (A) Stay is an action taken by a court to stop a legal proceeding or the actions of a party. A stay most commonly is issued by a court as a stay of proceedings in order to stop litigation from continuing, and they normally are only temporary. A court will do this for many reasons such as if there is another proceeding occurring that will affect the present one or if a party must do something before the proceeding can continue.”

Which State Lawsuits are Affected:

This stay does affect every state and every member, however, the state lawsuits are still in place. Of the Temporary Restraining Orders (TRO) that have been ruled on across the country, the only one that has been stayed right now is the Ohio case. That means that if a player in your team has a lawsuit outside of the Borovicanin v. NCAA case that has been given a TRO, that player continues to be eligible.

What about Borovicanin v. NCAA?

The players in the Borovicanin V. NCAA case are no longer eligible with both lawsuits currently having been granted a Stay. This affects the below players.

Filip Borovicanin, MJ Collins Jr., Malik Messina-Moore, Kolby King, Javon Bennett, Chevalier Emery Jr., Jalen Quinn, Savannah White, Donovan Brown, Christian Henry, Ziare Wells, Cristian Carroll, Shawn Phillips Jr., Caden Powell and Josh Reed.

Xavier (Borovicanin) and Cincinnati (Collins Jr.) both lost players today, at least temporarily. Both guys figured to be key pieces this upcoming season and without them both team’s floors are slightly lower.

Conclusion:

There is no doubt that the attorneys who are handling these cases will counter and push to get full decisions made expeditiously. However, with football starting next week, and basketball just around the corner, there is now quite the time crunch to get this done.
